By accessing and using the FixItForADollar website and services (the "Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to update these terms at any time without notice. Your continued use of the Platform following any changes constitutes your acceptance of the new terms.

Funding Eligibility: Funding approval and terms depend on your credit profile, financial history, business metrics, and lender requirements. We do not guarantee funding approval.

Tradeline Services: Authorized User tradeline accounts are credit-building tools. Adding yourself as an authorized user may impact your credit score positively or negatively depending on account activity, utilization, and payment history. Results vary by individual and credit bureau.

Disclaimer: Past funding success does not guarantee future approval. Lender requirements, rates, and terms change frequently and without notice.

You agree to:

• Provide accurate, complete, and truthful information at all times
• Keep your account credentials confidential and secure
• Not engage in fraud, misrepresentation, or illegal activity
• Not use the Platform for unlawful or harmful purposes
• Not attempt to gain unauthorized access to the Platform or other users' accounts
• Comply with all applicable federal, state, and local laws and regulations
• Review and maintain the accuracy of your personal information

7️⃣ Payment Terms

All fees are due upon service enrollment unless otherwise specified. We accept multiple payment methods including credit cards, ACH transfers, and wire transfers. Recurring billing will continue until you cancel your service.

Refunds: Refunds for credit repair services are available within 3 business days of purchase if you have not yet begun the dispute process. After disputes are filed, refunds are subject to the Credit Repair Organizations Act (CROA) guidelines.

Billing Disputes: Report any billing issues within 30 days of the transaction. We will investigate and respond within 15 business days.

8️⃣ Data Privacy & Security

Your personal and financial information is encrypted and protected using industry-standard security protocols. However, no online platform is completely secure. By using our Platform, you acknowledge and accept the inherent risks of transmitting sensitive information online.

We comply with all applicable privacy laws including FCRA, GLBA, CROA, and state privacy regulations. Your data will not be sold or shared with third parties without your explicit consent, except as required by law.

9️⃣ Affiliate & Referral Program

Our affiliate program allows you to earn commissions for valid referrals. By participating, you agree to:

• Not engage in false advertising or misrepresentation
• Clearly disclose your affiliate relationship to potential customers
• Not use paid search keywords that include our brand name without approval
• Comply with all FTC disclosure guidelines
• Accept commission rates and terms in effect at time of referral

Commission fraud, chargebacks, or suspicious activity will result in immediate program termination and forfeiture of unpaid commissions.

🔟 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FIXITFORADOLLAR AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR SERVICES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE PAST 12 MONTHS.

The Platform and services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or harmful code. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

⚖️ Indemnification

You agree to indemnify, defend, and hold harmless FixItForADollar and its officers, directors, employees, agents, and successors from any claims, damages, losses, liabilities, or expenses (including attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

🤝 Dispute Resolution & Arbitration

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except for claims seeking injunctive relief or arising from intellectual property infringement.

Arbitration shall be conducted under the American Arbitration Association (AAA) Commercial Arbitration Rules. Each party bears its own attorneys' fees and costs unless the arbitrator awards fees to the prevailing party.

Class Action Waiver: You agree not to participate in class actions or representative proceedings against FixItForADollar.

🏛️ Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the federal and state courts located in New York County.

🔗 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid, or if not possible, severed. The remaining provisions shall remain in full effect.

📄 Entire Agreement

These Terms, along with our Privacy Policy and any other policies posted on the Platform, constitute the entire agreement between you and FixItForADollar. No prior agreements, oral or written, are valid unless explicitly referenced herein.
